Terms of Service

These terms are the agreement between Nodebridge Inc., a Delaware corporation (“we”), and you, for the use of MakeSomeone.ai. Some services — including our social platform integrations — are provided through our subsidiary Nodebridge Canada Inc., and these terms apply to those equally. Using the service means accepting them. If you are accepting on behalf of a company, you are confirming you may bind it.

What MakeSomeone.ai does

MakeSomeone.ai builds storefronts and product pages, and creates AI characters that generate images, video and copy and publish them to social platforms you connect. We may change or add features; if we remove something you depend on we will give reasonable notice.

Your account

You must be 16 or older. Keep your credentials secure — you are responsible for what happens under your account. Tell us promptly at support@makesomeone.ai if you think it has been compromised.

Who owns what

You own what you put in — your products, photographs, brand and copy.

You own what comes out. As between you and us, the images, video and text MakeSomeone.ai generates for you are yours, to use commercially, once your account is in good standing. We keep a licence to host and process that material only so far as running the service requires.

We own MakeSomeone.ai itself — the software, the interface and the brand. Nothing here transfers that.

Two honest limits on generated output. Similar prompts can produce similar results for different customers, so we cannot promise your output is unique. And the law on copyright in AI-generated work is unsettled in most countries; we cannot promise it is registrable or enforceable as your own.

AI characters, and being straight about them

Characters made with MakeSomeone.ai are artificial, and you are responsible for saying so where you publish them. Platforms require it, and in the EU the AI Act requires it for photorealistic material resembling a person. We label content where a platform gives us the means; the duty to disclose is yours.

You agree not to use MakeSomeone.ai to:

• create a character in the likeness of a real person without their written consent;
• impersonate anyone, or imply an endorsement or affiliation that does not exist;
• make sexual content involving minors, or sexual content depicting a real person without consent;
• produce material that is unlawful, defamatory, or that incites harm;
• mislead people about a product’s nature, origin or price;
• breach the terms of any platform you connect.

We may suspend or remove content and accounts that breach this section. For clear harms — sexual content involving minors above all — we act immediately and without notice, and report where the law requires.

Connected platforms

When you connect Instagram, Facebook, TikTok or any other account, you confirm you are entitled to act for it, and you authorise us to publish on your instruction and read the figures we display.

Those platforms are not ours. Their rules govern your accounts, they can change their APIs or terms at any time, and they can restrict or remove an account for reasons we neither control nor are told. We are not responsible for a platform suspending, restricting or deleting your accounts or content, and an interruption caused by a platform is not a failure of this service.

Selling through MakeSomeone.ai

If you sell, the contract of sale is between you and your buyer. You are the merchant of record: you set the prices, describe the goods accurately, fulfil the orders, handle returns and account for your own taxes. Payments run through Stripe under Stripe’s terms.

Payment for MakeSomeone.ai

Paid plans are billed in advance and renew automatically until cancelled. Cancel any time; the plan runs to the end of the period you have paid for. We do not refund part-periods except where the law requires. We will give at least 30 days’ notice by email before a price change, and it takes effect at your next renewal.

Generation limits

Images and video cost real money to produce, so plans carry limits. We may apply fair-use limits to protect the service, and will tell you before doing so unless usage is causing immediate harm.

Ending it

You may close your account whenever you like. We may suspend or close an account that breaches these terms, and where circumstances allow we will explain why and give you a chance to put it right.

Export your work before you go. After closure we delete your content within 30 days, as described in the Privacy Policy.

Warranties and liability

MakeSomeone.ai is provided “as is”. We do not warrant that it will be uninterrupted or error-free, nor that generated output will be accurate, suitable for a purpose, or free of third-party claims. Review what you publish.

To the extent the law permits, we are not liable for indirect or consequential loss, lost profits, lost data or lost business, and our total liability in any twelve-month period is limited to what you paid us in that period.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

Indemnity

You will indemnify us against claims arising from your content, your products, the characters you publish, or your breach of these terms — including a claim that something you published infringed someone’s rights or misled someone.

Law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction. If you are a consumer, you keep the mandatory protections of the law where you live, and nothing here removes your right to bring a claim in your local courts where that right cannot be waived.

Changes

We will post changes here and update the date above. Material changes are emailed to account holders before they take effect. Continuing to use MakeSomeone.ai after that means accepting them.
